On 25th March 2022 new changes to the Highway Code will be introduced that all learner drivers and drivers should know about. These changes are strengthening the laws around the use of handheld mobile devices while driving, to improve road safety for all users and to help close the loopholes for those seeking to evade prosecution. Those caught breaking the law will face hefty fixed penalty fines and six points on their licence.

Currently, drivers are banned from texting or making a call while using a handheld device, from the 25th March 2022 this will be extended to include: checking social media, checking the time, unlocking your phone, accessing playlists, apps, the internet or games, using the camera, accessing playlists or checking notifications.

The Highway Code has also been revised to clarify that being stationary in traffic counts as driving that drivers are not allowed to use the hand-held device at traffic lights or in traffic jams.

Drivers are allowed to make a contactless payment using their mobile, but only while stationary at a toll or fast-food drive-through. Drivers are allowed to call 999 in emergencies when there is no safe place to pull over.

Drivers are allowed to continue using a device hands-free that is secured in a cradle of similar. However, they can still be charged if the police deem that they are not in proper control of their vehicle.
